Terms of Service

Loopie is a platform for sharing authentic moments with close friends via our Home Screen Widget, and discovering the world through Public and Event Loopies.

You must be at least 13 years old to use Loopie. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

Loopie Gold. We may offer a premium subscription service called "Loopie Gold" which unlocks additional features. If you choose to purchase Loopie Gold, you will be charged a subscription fee.

Payments. All payments are processed through the Apple App Store or Google Play Store. You agree to abide by their terms and conditions regarding payments, subscriptions, and refunds.

Auto-Renewal. Your subscription will automatically renew at the end of each subscription period unless you cancel it at least 24 hours before the end of the current period. You can manage and cancel your subscription in your device's account settings.

Price Changes. We reserve the right to change the price of Loopie Gold at any time. Any price changes will take effect at the start of the next subscription period following notice to you.

Mobile Services. The Service is accessible via a mobile device. To the extent you access the Service through a mobile device, your wireless service carrier's standard charges, data rates, and other fees may apply.

Mobile Software. We grant you a limited, non-exclusive, non-transferable, revocable license to use a compiled code copy of our mobile application for one account on one mobile device owned or leased solely by you, for your personal use.

Loopie offers software applications that are intended to be operated in connection with products made commercially available by Apple Inc. ("Apple"). With respect to such software, the following terms apply:

• Acknowledgement: You acknowledge that these Terms are concluded between you and Loopie only, and not with Apple. Loopie, not Apple, is solely responsible for the App and the content thereof.
• Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and Support: Loopie is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Warranty: Loopie is solely responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Third Party Beneficiary: You and Loopie acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

No Competitors. You may not access the Service if you are a direct competitor of Loopie, except with Loopie's prior written consent. In addition, you may not access the Service for purposes of monitoring its availability, performance, or functionality, or for any other benchmarking or competitive purposes.

You retain ownership of your photos. By posting content, you grant us a license to display it to your friends and on their widgets.

Prohibited Conduct: You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
• Harm minors in any way.
• Impersonate any person or entity.
• Upload content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
